In the United States, 50% of marriages end in divorce. Without question, emotional and financial difficulties often result in couples getting tangled in a web of division of property, debt, custody concerns, and spousal support. For parties that are in agreement, divorce remains an arduous and emotionally draining process. Yet, when parties are at odds, an already sensitive process becomes even more stressful and overwhelming.

In short, one spouse filing a petition, which is then submitted to a court, usually initiates the divorce process. Included on the petition is the reason, or grounds for divorce. Depending on the circumstances of the parties involved, temporary orders may be given until the official court date. For instance, if one spouse is dependent upon the other for financial support, the dependent spouse must ask the court for a temporary order for continued support. In the same way, a temporary custody order must be obtained if children are to remain with the dependent spouse.

Collaborative Law

Negotiation is a time for parties to make decisions relating to custody, visitation, property, and other support. Yet, when disputes arise or if parties are unable to resolve issues, Collaborative Law is a form of divorce mediation that helps guide couples through disputes without the costs and complexities associated with court proceedings.

Collaborative law may include working with other professionals including mental health specialists, child psychologists, or other experts that help preserve your rights. This also includes private investigators and CPAs.

Through the process of negotiation and collaborative law, many couples will not have to go to trial. This gives couples the best chance of obtaining the best outcome in their divorce.
